These Terms of Service (“Terms”) govern your access to and use of screenclear.ca and the services offered through it (the “Platform”), operated by ScreenClear Testing Services (“ScreenClear,” “we,” “us,” “our”). By using the Platform — including booking a test, receiving a certificate, verifying a certificate, or applying to become a testing provider — you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.

1. What ScreenClear is (and is not)

ScreenClear is a booking and results platform that connects people who need certified drug and alcohol testing with independent, approved testing providers across Canada. Tests are administered by licensed medical professionals (such as pharmacists, nurses, and doctors) at facilities operated by those providers.

ScreenClear is not a medical clinic, laboratory, or healthcare provider, and nothing on the Platform is medical advice. Testing providers in our network are independent businesses responsible for the professional services they deliver. ScreenClear reviews provider applications and verifies practitioner credentials before providers may record results, but providers are not employees or agents of ScreenClear.

2. Eligibility and accounts

You must be of the age of majority in your province or territory to book a test or open an account. Where testing of a minor is required by law or court order, booking must be completed by a parent, guardian, or authorized party. You are responsible for the accuracy of the information you provide and for keeping any account credentials confidential.

3. Booking and payment

  • Bookings are made online by selecting a location, test type, and appointment time, and paying the listed price. Prices are in Canadian dollars and may change at any time; the price shown at checkout is the price you pay.
  • You may book on your own behalf or, where you have authority to do so, on behalf of another person (for example, an employer booking for a candidate or employee). If you book for another person, you confirm that you are authorized to provide their information and that they are aware of the booking and of how their results will be shared.
  • The person being tested must present valid government-issued photo ID at the appointment. Testing may be refused without refund if identity cannot be verified.

4. Cancellations, rescheduling, and no-shows

Contact us before your appointment time to cancel or reschedule. Cancellations processed before the appointment time are eligible for a full refund. No-shows and cancellations after the appointment time are not refunded. If a testing provider cancels or is unable to perform your test, you will receive a full refund or the option to rebook.

5. Testing, results, and certificates

  • Tests are administered under chain-of-custody protocol by the testing provider’s licensed practitioners.
  • A negative result generates an electronic certificate bearing a unique certificate number, a QR code, and an online verification URL.
  • A presumptive positive result is recorded confidentially. No certificate is issued for a positive result. Where applicable, the sample may be sent to a laboratory for confirmation; confirmation typically takes several business days. Fees are not refunded in the event of a positive result.
  • Attempting to tamper with, adulterate, or substitute a sample is grounds for immediate refusal of service without refund, and the attempt may be recorded.
  • If you designated an employer or other recipient at checkout, that recipient automatically receives a copy of the certificate when a negative result is issued. Review our Privacy Policy for details on how results are handled.

6. Certificate verification

Verification pages accessed via a certificate’s QR code or URL confirm the authenticity of the certificate and display its details. Verification is provided as a convenience for legitimate recipients of a certificate. You may not use the verification service to harvest data, probe for valid certificate numbers, or misrepresent a certificate’s status.

7. No guarantee of acceptance

Certificates document a test administered under our protocols. Whether a certificate satisfies a particular requirement — of an employer, court, regulator, licensing body, or any other party — is determined solely by that party. ScreenClear does not guarantee that any certificate will be accepted for any specific purpose.

8. Acceptable use

You agree not to: falsify identity or booking information; impersonate another person at a test; alter, forge, or misrepresent a certificate; interfere with the operation or security of the Platform; scrape or harvest data from the Platform; or use the Platform for any unlawful purpose. We may suspend or terminate access, cancel bookings, and void certificates obtained through fraud or misuse.

9. Testing providers

Providers apply through the Become a Provider process and are subject to review and approval, including verification of business and practitioner credentials. Approved providers agree to additional provider terms governing service standards, chain-of-custody procedures, confidentiality, supplies, and payment. ScreenClear may suspend or remove a provider at its discretion, including for failure to maintain valid credentials.

10. Intellectual property

The Platform, including its content, design, certificate formats, and verification system, is owned by ScreenClear or its licensors and is protected by law. You may not copy, reproduce, or create derivative works from the Platform except as necessary to use it for its intended purpose.

11. Disclaimers

The Platform is provided “as is” and “as available.” To the maximum extent permitted by law, ScreenClear disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Platform will be uninterrupted or error-free, that any particular location, appointment, or test type will be available, or that results will be delivered within any specific timeframe. Screening tests have inherent scientific limitations; no test detects all substances or all use, and results reflect the sample collected at the time of collection.

12. Limitation of liability

To the maximum extent permitted by law, ScreenClear’s total liability for any claim arising out of or relating to the Platform or these Terms is limited to the amount you paid for the booking giving rise to the claim. ScreenClear is not liable for indirect, incidental, special, consequential, or exemplary damages — including lost employment, lost income, lost opportunities, or legal outcomes — arising from use of the Platform, a test result, a certificate, or the acceptance or rejection of a certificate by any third party. Testing providers are solely responsible for the professional services they provide. Nothing in these Terms limits liability that cannot be limited under applicable law, including under consumer protection legislation.

13. Indemnity

You agree to indemnify ScreenClear against claims arising from your breach of these Terms, your misuse of the Platform, or information you provide without proper authority (including booking a test for someone you were not authorized to book for).

14. Privacy

Our collection, use, and disclosure of personal information — including test results — is described in our Privacy Policy, which forms part of these Terms.

15. Changes to the Platform and these Terms

We may modify the Platform or these Terms at any time. Updated Terms take effect when posted, and the “Last updated” date will reflect the revision. Material changes will be posted prominently. Your continued use of the Platform after changes take effect constitutes acceptance.

16. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree to the exclusive jurisdiction of the courts of that province for any dispute arising from these Terms, subject to any mandatory consumer protection rights in your province of residence.
